Article 1: Definitions

In these terms and conditions, the following definitions apply:

  • Entrepreneur: Web Designer Studio, the natural person offering products and/or services to consumers at a distance;
  • Consumer: the natural person not acting in the exercise of a profession or business and entering into a distance agreement with the entrepreneur;
  • Distance agreement: an agreement whereby, within the framework of a system for distance sales of products and/or services organized by the entrepreneur, only distance communication is used;
  • Distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having to be simultaneously present in the same room.

Article 3: Applicability

These terms and conditions apply to every offer from the entrepreneur and to every concluded distance agreement between entrepreneur and consumer. Before the distance agreement is concluded, the text of these terms and conditions is made available to the consumer.

Article 4: The offer

The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to allow the consumer to properly assess the offer. If the entrepreneur uses images, these are a true representation of the offered products and/or services.

Article 5: The agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions. If the consumer has accepted the offer electronically, the entrepreneur immediately confirms receipt of the acceptance of the offer electronically.

Article 6: Exercise of the right of withdrawal

When purchasing services, the consumer has the option to dissolve the agreement without giving reasons during 14 days, starting on the day the agreement is concluded. During this period, the consumer will carefully handle the product and packaging. The consumer will only unpack or use the product to the extent necessary to assess whether they wish to keep the product.

Article 7: Pricing

During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates. All prices include VAT. The entrepreneur guarantees that the products and/or services meet the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions existing on the date the agreement is concluded.

Article 8: Execution of the agreement

The entrepreneur will exercise the utmost care in receiving and executing orders for products and in assessing requests for the provision of services. The place of delivery is the address that the consumer has communicated to the entrepreneur. The entrepreneur will execute accepted orders with due speed but no later than within 30 days, unless a longer delivery period has been agreed.

Article 9: Payment

Unless otherwise agreed, the amounts owed by the consumer must be paid within 14 days after concluding the agreement. The consumer has the obligation to immediately report inaccuracies in provided or stated payment details to the entrepreneur.

Article 10: Disputes

Agreements between the entrepreneur and the consumer to which these terms and conditions apply are exclusively governed by Dutch law. Disputes between the consumer and the entrepreneur about the conclusion or execution of agreements regarding products and services to be delivered by this entrepreneur can be submitted to the Disputes Committee Web Design by both the consumer and the entrepreneur, after being presented to the entrepreneur.

Article 11: Additional or deviating provisions

Additional or deviating provisions from these terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
